Terms & Conditions
Artisma MKT · Effective May 2026
These Terms and Conditions govern the contracting of Artisma's services, including website design and development, monthly support plans, and any additional services. Accepting a proposal or starting the project process implies full acceptance of this document.
1. Service description
Artisma designs and builds websites for companies, with content, forms and measurement connected to the client sales process. The scope, timeline and payment terms of each project are the ones stated in the proposal accepted by the client.
2. Project scope
Scope is defined at the Kick-off call. Window: individual page with a distinct URL. Section: a content block with a single purpose within a window. Header and footer are base components and do not count as additional sections. Any element outside the agreed scope is quoted separately.
3. Project process
Baseline measurement: Artisma installs analytics on the current site and records baseline metrics before any change.
Build and launch: Artisma designs, builds and publishes the new version, and measures it with those same metrics.
Results meeting: Artisma presents the comparison between the baseline and the published site. Monthly support begins from that point.
4. Review rounds
Artisma delivers a maximum of 2 review rounds: v1 (first delivery), v2 (adjustments), v3 (final version deployed). Structural changes after v3 approval are quoted separately.
5. Client responsibilities
The client must complete the Kick-off form, designate a primary contact, respond to reviews within agreed timeframes, and provide brand materials before project start. Delays attributable to the client automatically extend delivery timelines.
6. Approval of deliverables
A deliverable is considered approved when the primary contact provides written confirmation. Expressions such as "approved," "looks good," "proceed," or equivalent constitute formal approval.
7. Monthly support
Without an active support plan, Artisma cannot keep the site online. Upon termination of any support plan, the full source code is delivered to the client. Support is billed monthly and auto-renews unless cancelled with 15 days' notice.
8. Additional services
The client may contract blog writing, newsletters, social media management, and digital advertising. Each service has its own conditions confirmed in writing before production begins.
9. Intellectual property
The client retains all rights over their brand and materials. Source code and designs produced by Artisma become the client's property upon payment of the contracted plan. Artisma reserves the right to use completed projects as portfolio work, unless the client notifies otherwise in writing before final delivery.
10. Confidentiality
Artisma treats all strategic, commercial, and operational information shared by the client as confidential. It is not disclosed to third parties except as necessary to deliver the service.
11. Limitation of liability
Artisma does not guarantee specific business results. Results meeting metrics are an objective reference, not a promise of future performance. Artisma is not liable for interruptions caused by third parties or events outside its reasonable control.
12. Proposal validity
All quotes are valid for 15 calendar days from their date. After that period without confirmation, they may be revised or withdrawn.
13. Modifications
Artisma may update these terms at any time. Changes take effect upon publication. Ongoing projects are governed by the terms in effect at their start date.
14. Jurisdiction
This document is governed by the laws of Mexico. The parties submit to the competent courts of Mexico City, waiving any other jurisdiction.
